Neutral Experience

Type # Years # Cases Description of Experience
Mediator 30 100 I have mediated a broad range of cases and disputes since approximately 1990. I ordinarily begin mediations using a traditional process-driven approach, if that doesn't work I move toward a more fact-challenging and evaluative approach - according to parties' preferences.
Arbitrator 30 50 I earlier served on the SDSC's arbitration panel. I have arbitrated many cases of many types (both inside and outside the SDSC ADR program). My current general preference is to serve as a mediator rather than as an arbitrator, but I am willing to arbitrate cases in which mediation efforts have failed. My sense is that most arbitrations should start as arbitrations, rather than as mediations - due to confidences shared in the mediation setting.

Attorney Experience

# Years Description of Experience
40 Member of the CA state bar since 12/82 (SBN 105149). My practice has included work for plaintiffs and defendants in a broad array of tort, contract, insurance, and real estate cases/claims, e.g.,injured parties & torfeasors, carriers & insureds, corporate boards & shareholders, church denominations, churches & church members, homeowners, contractors & sub-contractors, property owners, and commercial landlords & tenants.

Other Relevant Experience

Type # Years Description of Experience
CA-licensed broker 17 I hold a CA DRE broker's license, keeping it current with mandatory continuing education. I am not a CAR or AIR CRE member and have not been affiliated with a major brokerage.
Settlement Days I have served as mediator for "Settlement Days" in which insurance carriers invite claimants in certain case types to engage in large-scale mediation events, with the mediator jumping between parties and mediations for a number of hours in hopes of resolving a substantial number of cases in a single day.
Class actions I also have experience in Rule 23 matters, mostly 23(b)(3) damages cases. As well, I have represented employers in wage and hour CA class matters.
